In 2012, a record number of Fair Labor Standards Act ("FLSA" or “The Act”) lawsuits were filed in Federal Court. As we move into 2013, the courts remain awash in these lawsuits — the majority of which are grounded in employers' misunderstanding or misapplying the fundamental elements of the Act. Misinformation and bad advice abound. Knowledge and a strong understanding of the Act are the best weapons employers can have in their arsenals to avoid those potential FLSA pitfalls that plague so many employers.
